Agreement to Terms

These Terms of Service ("Terms") govern the professional relationship between Jessica Neutz Writing Services ("Writer", "I", "me", "my") and any individual or organization ("Client", "you") who engages my services, whether through this website, email, or any other channel.

By submitting a project inquiry, signing a project proposal, paying a deposit, or otherwise engaging my services, you agree to be bound by these Terms. If you do not agree, please do not engage my services.

These Terms apply to all writing, editing, ghostwriting, content strategy, coaching, and related services provided by Jessica Neutz Writing Services.

Services & Scope of Work

The specific scope, deliverables, timeline, and pricing for each engagement are defined in a written project proposal or statement of work ("SOW") provided before work begins. The SOW, once accepted by the Client, forms part of these Terms.

Scope changes

Any additions to the agreed scope — additional pages, extra revision rounds, new content types, or expanded word counts — will be quoted separately and require written approval before work proceeds.

Rush projects

Projects requiring delivery in fewer than 5 business days carry a 25% rush surcharge, applied to the total project fee. Rush availability is not guaranteed and is subject to current workload.

Research & accuracy

I conduct independent research for all projects. However, the Client is responsible for verifying that all factual claims, statistics, legal statements, and medical information in final deliverables are accurate and appropriate for their specific context before publication.

AI policy

All deliverables are 100% human-written by me. I do not use AI tools to generate, draft, or substantially rewrite client content. This is a core commitment, not a marketing claim.

Payment Terms

Payment terms are outlined in each project proposal. The standard structure is as follows:

Work begins upon receipt

Accepted payment methods: Bank transfer (ACH), PayPal, Venmo, or check. Payment details are provided on each invoice.

Late payments: Invoices unpaid after 14 days of the due date are subject to a 1.5% monthly late fee. I reserve the right to pause or suspend work on active projects until outstanding balances are settled.

Disputed invoices: If you believe an invoice contains an error, notify me in writing within 7 days of receipt. Undisputed portions of an invoice remain due on the original payment date.

Revisions & Feedback

Every project includes two full revision rounds at no additional charge. A revision round means you may request changes to tone, structure, content, and messaging — not just copy edits.

Revision window: Revision requests must be submitted within 14 days of draft delivery. Feedback received after this window may be treated as a new project or billed at the hourly rate.

Additional revisions: Revision rounds beyond the two included are billed at $85/hour, invoiced after completion.

Scope creep: Revision requests that substantially change the original brief — new topics, different target audiences, complete structural overhauls — may be treated as a scope change and quoted separately.

Client feedback responsibility: Clear, consolidated feedback helps me deliver better revisions faster. I ask that feedback be provided in a single document or email rather than in multiple separate messages.

Ownership & Usage Rights

Ownership of deliverables transfers to the Client upon receipt of full payment. Until final payment is received, all work remains the intellectual property of Jessica Neutz Writing Services.

Full commercial rights (upon full payment)

You may publish, edit, translate, repurpose, and monetize the content in any medium without restriction or additional licensing fees.

Portfolio use

Unless a Non-Disclosure Agreement is in place, I reserve the right to reference the project type and industry in my portfolio (without reproducing the full content or identifying the Client by name without permission).

Ghostwriting & NDAs

All ghostwriting engagements include a standard NDA. I will not disclose that I wrote the content, claim authorship publicly, or reference the project in any way that could identify the Client. Additional confidentiality provisions can be accommodated upon request.

Cancellation & Refunds

Either party may cancel a project with written notice. The following terms apply:

If I need to cancel a project due to unforeseen circumstances, I will provide as much notice as possible and refund any fees paid for work not yet completed.

Confidentiality

I treat all Client information — business strategies, internal data, unreleased products, financial information, and any other non-public information shared during a project — as strictly confidential.

This obligation of confidentiality applies during and after the engagement, with no expiration date, unless the information becomes publicly available through no fault of mine.

Clients who require a formal NDA before sharing sensitive information are welcome to provide one for review and signature before the project begins. I routinely sign client NDAs and have no objection to doing so.

Client Responsibilities

A successful project is a collaboration. To ensure the best outcome, Clients agree to:

  • Provide accurate, complete, and timely information, materials, and feedback as requested
  • Respond to questions and review drafts within the agreed timeline (typically 5–7 business days)
  • Ensure that any materials provided (brand guidelines, existing content, data, images) do not infringe on third-party intellectual property rights
  • Verify the accuracy of all factual claims, legal statements, and medical information before publishing final content
  • Not use deliverables in any way that is unlawful, defamatory, or harmful to others
  • Obtain any necessary permissions or licenses for third-party content incorporated into deliverables at your direction

Limitation of Liability

To the fullest extent permitted by applicable law, Jessica Neutz Writing Services shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of deliverables, including but not limited to:

  • Loss of revenue, profits, or business opportunities
  • Damage to reputation or brand
  • SEO ranking changes or search engine penalties
  • Errors in factual content that was not flagged or corrected by the Client during the review process
  • Third-party claims arising from content published by the Client

My total liability for any claim arising from a project shall not exceed the total fees paid for that specific project. This limitation applies regardless of the form of action, whether in contract, tort, or otherwise.

Warranties & Representations

I warrant that:

  • All deliverables are original work created by me and do not knowingly infringe on any third-party copyright
  • I have the right to enter into this agreement and provide the services described
  • Deliverables will be written with reasonable professional skill and care
  • No AI-generated content will be passed off as human-written work

I do not warrant specific outcomes such as search engine rankings, conversion rates, publication acceptance, grant award decisions, or any other result dependent on factors outside my control.

Governing Law & Disputes

These Terms are governed by the laws of the State of Michigan, United States, without regard to its conflict of law provisions.

In the event of a dispute, both parties agree to first attempt resolution through good-faith written communication. If a dispute cannot be resolved informally within 30 days, it shall be submitted to binding arbitration in Livingston County, Michigan, under the rules of the American Arbitration Association.

Nothing in this section prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm.

Changes to These Terms

I may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Changes take effect for new projects initiated after the updated Terms are posted. Ongoing projects at the time of a change continue under the Terms in effect when the project began, unless both parties agree in writing to the updated Terms.
